Terms of website use

This page (together with the documents referred to on it) tells you the terms (“terms”) on which you may make use of our website www.housebid21.co.uk (our site) or any services provided by our site, whether as a guest or a registered user. Please read these terms carefully before you start to use the site. By using our site, you indicate that you accept these terms and that you agree to abide by them. If you do not agree to these terms, please refrain from using our site.

Information about us

www.housebid21.co.uk is a site operated by House Bid 21 Limited  ("We").  We are registered in England and Wales under company number 06427496 and have our registered office at St Mary’s House, Netherhampton, Salisbury SP2 8PU.

Accessing our site

We reserve the right to withdraw or amend the service we provide on our site without notice (see below). We will not be liable if for any reason our site is unavailable at any time or for any period.

Access to parts of our site may require you to register.   A fee may be also payable on registration before such access is granted and details of the applicable fees are set out on our site.  You warrant that all details you provide as part of the registration process are accurate.

When using our site, you must comply with our acceptable use policy (see below).

Using our site – the Bidding Process

Our site offers a potential vendor (“Vendor”) the opportunity, through a participating estate agent (“Agent”) to advertise their property for a period of 21 days and to indicate they are open to receiving indications of interest (“Bids”) for their property from an interested party (“Bidder”).  

No Bid can be made by any person who is not registered on our site as a Bidder. 

No Bid made via our site is binding on either party and a property may be withdrawn at any time by a Vendor even if no Bid has been accepted.

Use of our site does not alleviate a Bidder’s responsibility from making the usual investigations and enquiries which a reasonably prudent buyer would be expected to make prior to entering a contract to purchase a property.

If you are a Bidder, by placing a Bid through our site, you warrant that:

  • you are legally capable of entering into binding contracts; and
  • you have or able to source sufficient funds to honour the Bid which you have made should your Bid be accepted by the owner of the property.

If you are a Vendor, by agreeing to allow your property to be advertise through our site, you warrant that You own or are otherwise legally entitled to enter into a binding contracts for the sale of that property.

If are an Agent, by placing details of a property on our site, you warrant that:-

  • you have the consent of the Vendor to place their property on our site at the advertised starting price;
  • the details of all properties posted to our site by you comply with the Property Misdescriptions Act 1991 as well as any other applicable laws or regulations governing the advertising and selling of properties in the location where the property is located;
  • you own or are the licensee of all copyright and intellectual property (if any) in the material uploaded to the site; and
  • a home information pack (“HIP”) is available for Bidders for that property.

You agree to indemnify us for any breach by you of any of the above warranties that apply to you.

Uploading material to our site

Only Agents may upload details of properties and if you are an Agent you hereby grant us a royalty-free licence to display material uploaded on our site.

All material posted must also comply with the content standards set out below and we have the right to remove any material posted if, in our opinion, such material does not comply with that content standards.

We reserve the right to disclose your identity to any third party who is claiming that any material posted or uploaded by you to our site constitutes a violation of their intellectual property rights, or of their right to privacy.

Reliance on information posted

Information and other materials posted on our site are not intended to amount to advice on which reliance should be placed and details of any property listed should be verified with the relevant Agent by a Bidder before bidding. 

Intellectual property rights

We are the owner or the licensee of all intellectual property rights in our site, and in the material published on it.  All such rights are reserved.

You may print off one copy, and may download extracts, of any page(s) from our site for your personal reference.

You must not modify the paper or digital copies of any materials you have printed off or downloaded in any way, and you must not use any illustrations, plans, photographs, or other visual separately from any accompanying text.

Our status (and that of any identified contributors) as the authors of material on our site must always be acknowledged.

You must not use any part of the materials on our site for commercial purposes without obtaining a licence to do so from us or our licensors.

If you breach of these terms, your right to use our site will cease immediately and you must, at our option, return or destroy any copies of the materials you have made.

Our liability

The material displayed on our site is provided without any guarantees, conditions or warranties as to its accuracy.

To the extent permitted by law, we expressly exclude:

  • all conditions, warranties and other terms which might otherwise be implied by statute, common law or the law of equity.
  • all liability and responsibility arising from any reliance placed by you (or by anyone to who the site’s contents are given) on materials posted on our site by you,.
  • any liability for any direct, indirect or consequential loss or damage incurred by any user of our site in connection with the use, inability to use, or results of the use of our site, any websites linked to it and any materials posted on it, including, without limitation any liability for:
    • loss of income or revenue;
    • loss of business;
    • loss of profits or contracts;
    • loss of anticipated savings;
    • loss of data;
    • loss of goodwill;
    • wasted management or office time; and
    • for any other loss or damage of any kind, however arising and whether caused by tort (including negligence), breach of contract or otherwise, even if foreseeable

This does not affect our liability for death or personal injury arising from our negligence, nor our liability for fraudulent misrepresentation or misrepresentation as to a fundamental matter, nor any other liability which cannot be excluded or limited under applicable law.

Information about you and your visits to our site

Acceptable Use policy

You may use our site only for lawful purposes.  You may not use our site:

  • in any way that breaches any applicable local, national or international law or regulation.
  • in any way that is unlawful or fraudulent, or has any unlawful or fraudulent purpose or effect.
  • To send, knowingly receive, upload, download, use or re-use any material which does not comply with our content standard (see below).
  • To transmit, or procure the sending of, any unsolicited or unauthorised advertising or promotional material or any other form of similar solicitation (spam).

You also agree not to access without authority, interfere with, damage or disrupt any part of our site including any equipment or network on which our site is stored or any software used in the provision of our site nor misuse our site by knowingly introducing viruses, trojans, worms, logic bombs or other material which is malicious or technologically harmful.

In relation to all material which you upload to our site (contributions) you must comply with the following content standard (“Content Standard”) so that contributions must not:

  • infringe any copyright, or other intellectual property right of any other person.
  • be likely to deceive any person.
  • be made in breach of any legal duty owed to a third party, such as a contractual duty or a duty of confidence.
  • promote any illegal activity or be defamatory or offensive.
  • be used to impersonate any person, or to misrepresent your identity or affiliation with any person.

You must comply with the spirit of the following content standards as well as the letter. The standards apply to each part of any contribution as well as to its whole.

Linking to our site

You may link to our home page only, and provided you do so in a way that is fair and legal and does not damage our reputation or take advantage of it, but you must not establish a link in such a way as to suggest any form of association, approval or endorsement on our part where none exists.

You must not establish a link to any other part of our site without our consent nor from any website that is not owned by you.

Our site must not be framed on any other site, nor may you create a link to any part of our site other than the home page. We reserve the right to withdraw linking permission without notice.

Suspension and termination

We will determine, in our discretion, whether there has been a breach of these terms.  When a breach has occurred, we may take such action as we deem appropriate which may include all or any of the following actions:

  • Immediate, temporary or permanent withdrawal of your right to use our site.
  • Immediate, temporary or permanent removal of any material uploaded by you.
  • Issue of a warning to you.
  • Legal proceedings against you for reimbursement of all costs on an indemnity basis (including, but not limited to, reasonable administrative and legal costs) resulting from the breach.
  • Further legal action against you.
  • Disclosure of such information to law enforcement authorities as we reasonably feel is necessary.

The responses described above are not limited, and we may take any other action we reasonably deem appropriate.

Jurisdiction and applicable law

The English courts will have exclusive jurisdiction over any claim arising from, or related to, a visit to our site.  These terms are governed by English law.

Our site changes regularly

We aim to update our site regularly, and may change the content at any time. If the need arises, we may suspend access to our site, or close it indefinitely. Any of the material on our site may be out of date at any given time and we are not obliged to update such material.

We may revise these terms at any time by amending this page. You are expected to check this page from time to time to take notice of any changes we made, as they are binding on you.  Some of the provisions contained in these terms may also be superseded by provisions or notices published elsewhere on our site.  The current version posted on the site at the time of your visit will apply at the time you use our site.

Notices

All notices given by you to us must be given to House Bid 21 Ltd at 49 Castle Street, Salisbury SP1 3SP.

We may give notice to you by email or post to any address you provide to us on registration or by posting a general notice on our site.

Notice will be deemed received and properly served immediately when posted on our website, 24 hours after an e-mail is sent, or three days after the date of posting of any letter. 

In proving the service of any notice, it will be sufficient to prove, in the case of a letter, that such letter was properly addressed, stamped and placed in the post and, in the case of an e-mail, that such e-mail was sent to the specified e-mail address of the addressee
